Replacement Terms of Service

These Terms of Service govern access to and use of the IIIYV website, products, content, and related services.

The website and store are operated by IIIYV LLC. Throughout these Terms, “IIIYV,” “we,” “us,” and “our” refer to IIIYV LLC. “You” and “your” refer to any visitor, customer, account holder, or other user of the website.

By accessing the website, creating an account, or placing an order, you agree to these Terms and to the policies referenced within them. If you do not agree, do not use the website or purchase products through it.

Nothing in these Terms limits consumer rights that cannot legally be waived.

1. Eligibility and Accounts

You must be legally capable of entering into a binding agreement in your jurisdiction to make a purchase through IIIYV. A minor may use the website only with the involvement and permission of a parent or legal guardian.

You agree to provide accurate, current, and complete information when creating an account or placing an order.

You are responsible for:

Protecting your account credentials
Restricting unauthorized access to your account
Reviewing information submitted through your account
Promptly notifying IIIYV of suspected unauthorized use

IIIYV may suspend or restrict an account when reasonably necessary to protect customers, the business, or the website.

2. Permitted Use

The website may be used only for lawful personal or commercial shopping purposes consistent with these Terms.

You may not:

Use the website for unlawful, fraudulent, or abusive activity
Interfere with the website’s operation or security
Introduce viruses, malware, or harmful code
Attempt to gain unauthorized access to systems, accounts, or information
Impersonate another person or provide false information
Scrape, copy, harvest, or collect website content or customer information through automated means without authorization
Circumvent purchasing limits, security controls, or fraud-prevention measures
Use IIIYV content or intellectual property without permission
Use the website in a manner that infringes the rights of IIIYV or another party

IIIYV may restrict access, cancel orders, or take other reasonable action when these requirements are violated.

3. Product Information

IIIYV makes reasonable efforts to present product descriptions, measurements, materials, colors, photographs, and availability accurately.

However:

Colors may appear differently depending on the customer’s screen, lighting, and display settings.
Measurements and sizing may vary slightly because of manufacturing tolerances.
Materials, finishes, and placement may have minor variations between production runs.
Product packaging may differ from photographs.
Product information may occasionally contain errors or require updates.

Customers should review product descriptions and available sizing information before ordering.

4. Vintage, Pre-Owned, and Unique Merchandise

Some IIIYV products may be vintage, pre-owned, limited-production, handmade, customized, or one-of-one merchandise.

Vintage and pre-owned products may display age, fading, wear, repairs, distressing, or other characteristics consistent with their history. These characteristics are not considered defects when they are reasonably disclosed in the product description or photographs.

Sizing on vintage merchandise may differ from modern sizing. Customers should rely on the measurements provided when available.

Because certain merchandise is unique or limited, an identical replacement may not be available.

References to third-party brands, teams, schools, leagues, organizations, or trademarks identify or describe the applicable merchandise. Unless a product page expressly states otherwise, such references do not mean that IIIYV is sponsored, endorsed, licensed, or affiliated with the applicable rights holder.

5. Product Availability and Purchasing Limits

Products are subject to availability and may be changed, limited, discontinued, or removed without notice.

Adding merchandise to a cart does not reserve it. Limited-release and one-of-one merchandise may sell before checkout is completed.

IIIYV may establish purchasing limits for particular products, customers, households, payment methods, or orders. We may cancel or restrict orders reasonably believed to involve:

Fraud or unauthorized payment activity
Automated purchasing or bots
Circumvention of product limits
Pricing or inventory errors
Unauthorized bulk purchasing
Activity that threatens the fair availability of a limited release

When IIIYV cancels a paid order, the applicable payment will be refunded or voided.

6. Prices, Taxes, and Promotions

Prices are displayed on the website and may change without notice. A price change will not ordinarily affect an order that IIIYV has already accepted.

Applicable taxes, shipping costs, duties, and other charges are calculated or displayed during checkout when available.

Promotional codes, discounts, and special offers:

Apply only during the stated promotional period
May be subject to eligibility requirements or product exclusions
Cannot be redeemed for cash
Cannot be combined unless expressly permitted
May be changed or withdrawn before an order is placed

IIIYV may correct pricing, discount, or promotional errors. When a material error affects an order, IIIYV may contact the customer for instructions or cancel and refund the affected order.

7. Orders and Order Acceptance

Submitting an order is an offer to purchase the products listed in the order.

An automated order confirmation acknowledges that IIIYV received the order. It does not prevent IIIYV from reviewing or canceling the order for reasons including:

Product unavailability
Payment failure
Suspected fraud
Incorrect pricing
Invalid shipping information
Purchasing-limit violations
A technical or inventory error

Customers are responsible for reviewing their order information before completing checkout.

8. Payment

Available payment methods are displayed during checkout and may change over time.

By submitting payment information, you represent that:

The information is accurate
You are authorized to use the payment method
IIIYV and its payment processors may charge the order total
Additional verification may be requested when reasonably necessary

Payments are processed through third-party payment providers. IIIYV does not directly control a bank, card issuer, digital wallet, or payment provider’s authorization, processing, settlement, or refund timeline.

9. Shipping and Delivery

Shipping rates, methods, processing, tracking, split shipments, international charges, delivery issues, and carrier delays are governed by the IIIYV Shipping Policy, which is incorporated into these Terms.

Customers are responsible for providing a complete and accurate shipping address.

Delivery estimates are not guarantees. IIIYV will provide reasonable assistance with delivery issues but cannot control carrier operations, customs processing, weather disruptions, or other events outside its reasonable control.

10. Order Changes and Cancellations

To request an address change or cancellation, contact help@the3yv.com as soon as possible.

IIIYV will make a reasonable effort to assist, but changes and cancellations cannot be guaranteed after an order has entered processing, production, or fulfillment.

Customized, personalized, limited-production, or already fulfilled orders may be impossible to cancel.

11. Returns and Refunds

Returns, exchanges, damaged merchandise, Final Sale products, and refunds are governed by the IIIYV Return & Refund Policy, which is incorporated into these Terms.

Customers must contact IIIYV and follow the applicable return instructions before mailing merchandise.

12. Gift Cards and Store Credit

Gift cards and store credit may be used only as permitted by the terms displayed when issued.

Except where required by law:

Gift cards are not redeemable for cash
Gift cards cannot be used to purchase another gift card
Lost or stolen gift-card information may not be replaceable
Store credit may be limited to the customer account or currency in which it was issued

Fraudulently obtained gift cards or store credit may be canceled.

13. Intellectual Property

The website and its content—including names, logos, graphics, photographs, videos, product designs, written content, layouts, and other materials—are owned by IIIYV, licensed to IIIYV, or used with appropriate authorization.

The names IIIYV, 3YV, THRĪVE, associated logos, and related brand elements may not be copied, reproduced, altered, distributed, sold, or used commercially without written permission.

Access to the website does not transfer ownership or grant a license to IIIYV intellectual property except for the limited personal right necessary to browse and shop through the website.

14. Reviews, Feedback, and Submitted Content

When you submit a review, photograph, comment, suggestion, testimonial, or other content to IIIYV, you represent that:

You have the right to submit it
It is accurate to the best of your knowledge
It does not violate another person’s rights
It is not unlawful, threatening, deceptive, defamatory, or harmful

You grant IIIYV a non-exclusive, worldwide, royalty-free right to reproduce, display, edit, distribute, and use submitted content in connection with operating, improving, and marketing IIIYV and its products.

IIIYV may moderate or remove submitted content that violates these Terms or is otherwise inappropriate for the website. IIIYV is not required to publish every submission.

15. Third-Party Services and Links

The website may use or link to services operated by third parties, including Shopify, payment processors, fulfillment providers, carriers, analytics providers, social-media platforms, and marketing services.

Third-party services may be governed by their own terms and privacy practices. IIIYV is not responsible for a third party’s independent content, security, availability, or conduct, except to the extent responsibility cannot be excluded under applicable law.

A link to a third-party service does not necessarily constitute endorsement.

16. Privacy

IIIYV’s collection, use, and disclosure of personal information are described in the IIIYV Privacy Policy.

By using the website, you acknowledge that information may be processed by IIIYV and its service providers as described in that policy.

17. Email and Text Messaging

Customers may receive transactional communications concerning orders, payments, shipping, returns, security, or customer-service requests.

Marketing emails may be discontinued by using the unsubscribe option included in the message. Unsubscribing from marketing does not prevent necessary transactional communications.

When a customer voluntarily opts into SMS or MMS marketing, the separate Messaging Terms and Messaging Privacy Policy presented during enrollment also apply.

SMS consent is not a condition of purchase. Message and data rates may apply, message frequency may vary, and customers may reply STOP to cancel or HELP for assistance.

18. Errors, Omissions, and Website Availability

IIIYV may correct errors, inaccuracies, or omissions relating to products, descriptions, pricing, promotions, shipping, availability, or other website content.

The website may occasionally be unavailable because of maintenance, technical failures, third-party services, security issues, or events outside IIIYV’s control.

IIIYV does not guarantee uninterrupted or error-free website access.

19. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an “as available” basis.

IIIYV does not guarantee that:

The website will always be available or error-free
All website content will remain current at every moment
Every product will be continuously available
Third-party services will operate without interruption

These disclaimers do not exclude product warranties, statutory guarantees, or consumer protections that cannot legally be waived.

20. Limitation of Liability

To the fullest extent permitted by law, IIIYV will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website, inability to use the website, or purchase of merchandise.

Where liability may legally be limited, IIIYV’s total liability concerning a product, order, or transaction will not exceed the amount paid for the product or transaction giving rise to the claim.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, or any other liability that cannot legally be excluded.

21. Indemnification

To the extent permitted by law, you agree to be responsible for losses, claims, or reasonable expenses resulting from your unlawful misuse of the website, infringement of another party’s rights, or material violation of these Terms.

This provision does not apply where the loss was caused by IIIYV or where applicable consumer law prohibits it.

22. Suspension and Termination

IIIYV may suspend or terminate access to the website when a user:

Materially violates these Terms
Engages in fraud or unlawful activity
Threatens the website’s security or operation
Misuses IIIYV intellectual property
Harasses customers, staff, contractors, or service providers

Termination does not eliminate payment obligations or other provisions that reasonably survive termination.

23. Governing Law and Disputes

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.

To the extent legally permitted, disputes arising from these Terms or a purchase from IIIYV will be brought in the appropriate state or federal courts located in or serving Hamilton County, Tennessee.

Customers may first contact help@the3yv.com so that IIIYV has an opportunity to review and attempt to resolve the issue.

This section does not deprive a consumer of mandatory rights, protections, or lawful remedies available in the consumer’s place of residence.

24. Changes to These Terms

IIIYV may update these Terms to reflect changes in its operations, products, services, technology, or legal obligations.

The updated version becomes effective when posted with a revised “Last updated” date. The version in effect when an order was placed will generally govern that order unless applicable law requires otherwise.

25. Severability and Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

A failure by IIIYV to enforce a provision on one occasion does not waive the right to enforce it later.

26. Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Return & Refund Policy, and any additional terms presented for a specific product, promotion, or service, form the agreement between the customer and IIIYV concerning use of the website and purchases through it.
